Summary Judgement Pending

Hello all,

Mom went down to DC on May 3 to give her deposition to WMATA's lawyer and the lawyer for WMATA's retirement plan. The questioning lasted about and hour and Mom felt very comfortable answering what she could.

A Motion for Summary Judgement was filed on April 20, requesting that a decision be made on the case without trial. We feel that this case has been delayed enough and WMATA has had enough time to review the submitted documents.

On June 2, WMATA filed their own Motion for Summary Judgement, and "...requests the Court to deny Plaintiff’s motion for summary judgment. For the reasons set forth above and as more fully developed in its Memorandum of Points and Authorities in support of its motion for summary judgment and the supporting documentation thereto, Defendant Plan requests the Court to grant its motion for summary judgment and dismiss the Plaintiff’s case in its entirety with prejudice."

Basically, they want the judge to accept their Motion, dismiss ours, and prevent us from filing further suit in court.

We will be filing a response soon, which could lead to a response from them. The judge then can rule in our favor, rule in their favor, or decide that based on the case a hearing will be held.

Either way, we hope to know SOMETHING by July 1.

Mediation Hearing Delayed

The Mediation Hearing for Dad that was supposed to be on March 8, has been delayed. At this time there has been no indication of when a new Hearing will be set.

We are working with our lawyer to get this case settled once and for all for Mom, so she can move on from this. We are in the process of requesting a Motion for Summary Judgement on the case. Apparently this filing will require WMATA to act by either settling out of court, or denying the motion and requesting another Mediation.

If during the Mediation we are not happy with the terms, we can request a full jury trial.

Dad's Story on Unsuck DC Metro

Unsuck DC Metro (http://unsuckdcmetro.blogspot.com/) has been in contact with us for a few weeks now. He heard about Dad's story through AllFacebook.com and reached out to us.

Paul F. Ludwig III - February 1,1949 - August 10,2010

As many of you know, Officer Ludwig passed away last night. He was surrounded by his family. He was in no pain and peacefully drifted off to sleep. All of his afflictions and ailments are no more, and he is with God. God bless you all!.

WMATA Responds to Overwhelming Support for Dad by "Blocking and Deleting"

Well Monday was a good day.

Many, many supporters of Dad's posted, emailed, called, and generally caused a busy day for WMATA.

In true WMATA fashion (should we be surprised) they decided the best way to deal with us was to block us on Facebook, and then delete ALL of their posts and our comments with them.

So AGAIN their tactic is to ignore and push aside.

Well that didn't stop Dad's supporters from finding other ways to get through. We saw that many of you commented on the Metro comments page, many contacted local news agencies, and others made numerous phone calls to all over WMATA.

We are so very grateful! We are still in awe of everything that is happening. To read all of your posts and to see what you, total strangers, are doing for my Dad is incredible!

You have all touched my heart so much. Thank you, thank you for your efforts!

God is with us, and tomorrow is another day!!!
